Pursuant to Article 13 of EU Regulation No. 679/2016 (hereinafter "GDPR") and Legislative Decree 196/2003 and subsequent amendments, I. Blu S.r.l.  (hereinafter "the Company") provides the following information regarding the processing of personal data (hereinafter "Data") of users of the website www.blupolymer.com (hereinafter "the Website").

B. DATA SUBJECT TO THE PROCESSING 

The data processed may consist of identifying data, data related to location, an online identifier, or one or more elements capable of making the data subject identified or identifiable.

1) Data processed during navigation.


More specifically, browsing the Website involves receiving cookies, which are short text strings that the websites visited send to the user's browser, where they are stored to be sent back to the same websites during subsequent visits.  While browsing a website, the user may also receive cookies from sites or web servers different from the one they are visiting (so-called "third-party" cookies). There are various types of cookies, as follows:

a) Technical cookies, which allow carrying out Website operations;
b) Profiling cookies, which are used to analyze user behavior and possibly send advertising messages in line with the preferences expressed by the user during browsing.

 

In more detail, the Website uses only the following technical cookies:

  • Affinity - Technical cookie

It is used to ensure performance and reliability by directing the user to backend systems capable of maintaining session status.  This cookie is used solely for this purpose and is not shared with any third party.

Profiling cookies are not used. 

 

2) Additional data voluntarily provided by the user

The optional, explicit, and voluntary submission of emails (through the Contact form or in any case through the addresses listed on the website) involves the subsequent acquisition of the sender's address, needed to respond to requests, as well as any other personal data included in the request.


 Processing can only occur with valid consent expressed by the reporting party under Article 6.1.a GDPR and 9.2.a GDPR in the following cases:

  •  If it is necessary to reveal the identity of the reporting person and any other information from which such identity can be directly or indirectly understood by individuals other than those authorized to receive or follow up on the reporting (pursuant to Article 12, paragraph 2, of Legislative Decree 24/2023).
  • If awareness of the identity of the reporting person is essential for the defense of the accused in the event of disciplinary action based in full or in part on the reporting (pursuant to Article 12, paragraph 5, of Legislative Decree 24/2023);
  • If reporting is issued via a recorded telephone line or another recorded voice messaging system, to proceed with documenting the report by recording it on a device suitable for storage and playback, or by means of a full transcription (pursuant to Article 14, paragraph 2, of Legislative Decree 24/2023);
  • If reporting is performed verbally during a meeting with the designated personnel, to proceed with documenting the report by recording it on a device suitable for storage and playback, or by means of a written record (pursuant to Article 14, paragraph 4, of Legislative Decree 24/2023).

 

C. LEGAL BASIS, NATURE, AND PURPOSE OF THE PROCESSING

The following purposes are pursued through the use of cookies:

  • To allow navigation of the Website and ensure its smooth functionality.   The legal basis for the processing is the provision of services to users of the Website and the legitimate interest of the Data Controller in having an operational website.
  • To allow providing the services made available by the Company.   The legal basis for the processing is the need to execute a contract in which the data subject is a party, or to implement pre-contractual measures requested by the same.
  • To comply with any obligations provided by current laws, regulations, or community legislation, or to meet requests from authorities.   The legal basis for the processing is the obligation for the Data Controller to comply with binding legal requirements.
  • For the purpose of defending the Data Controller’s rights in the context of any disputes, including in legal proceedings.   The legal basis for the processing is the legitimate interest of the Data Controller in protecting its rights.
  • Providing the data is optional, but failure to provide the data prevents the Data Controller from allowing navigation of the Website.

D. DATA RECIPIENTS

The Data may be communicated to:

  1.  Third parties that need to carry out specific activities related to the Data, in accordance with the purposes of the processing, or to service providers for the Data Controller.
  2. Public authorities, agencies, and/or individuals to whom the Data must be communicated, in compliance with binding legal or contractual obligations.

E. DATA TRANSFER

There is no data transfer outside the European Economic Area (EEA).


F. DATA RETENTION

The Data will be retained for the time strictly necessary to achieve the purposes of the processing, applying principles of minimization and proportionality. In any case:

  • Regarding the processing carried out for the provision of services, the Company will retain the Data for the time established and allowed by Italian law to protect its interests (Article 2946 of the Civil Code and following). 
  • Regarding Data processed to fulfill legal obligations, the Data will be retained for the time required by the specific applicable legal obligation or regulation. 
  • Regarding the duration of the Data processed through cookies, the technical cookies used do not involve any retention of the collected data.

 

G. RIGHTS OF THE DATA SUBJECTS 

Pursuant to Articles 15 and following of the GDPR, the data subject has the right to request from the Company access to their Data, rectification or erasure of the Data,
objection to the Data processing, and restriction of processing in the cases established by Article 18 of the GDPR. In addition, the Data Subjects have the right to obtain the Data concerning them in a structured, commonly used, and machine-readable format, in the cases established by Article 20 of the GDPR.
Requests should be made in writing to the Company at the addresses provided above.
In any case, the Data Subject shall always have the right to lodge a complaint with the competent oversight authority, namely the Italian Data Protection Authority  (Garante per la Protezione dei Dati Personali), pursuant to Article 77 of the GDPR, if they believe that the processing of their Data is in breach of the applicable regulations.
